Trademark registration in Canada

Trademark registration in Canada starts with the filing of an application. After filing the application, the Canada IP Office conducts the examination for approval. If the trademark is found to be acceptable, it shall be advertised in the Trademarks Journal for opposition (challenges) purposes and registration. If no opposition filed against the mark, the application shall proceed to registration, and a certificate of registration shall then be issued.

The official fee for the electronic filing of a trademark application will be CAD 335.93 for the first class and CAD 101.80 for each additional class.

The examination of the trademarks in Canada  includes an examination for inherent registrability and technical compliance with the Trademarks Act, as well as an examination on potential confusion with prior pending applications or registrations.

It takes about  24 to 50 months from filing to registration of a trademark in Canada.

We charge a service fee of 395CAD on top of the official fee.
